In an abundance of caution, I ran the article by a few black colleagues (friends from law school) prior to publishing. We're frequently, but not always, on the same page regarding racial dynamics, but they didn't express the concerns you're raising and actually agreed with the points I made. I appreciate your comments, but they would be more helpful if they included some detail.
